Decisions

1.              That the Western Bay Area Plan for Care and Support Needs (2018-2023) and Action Plan (2018-19) attached as Appendix 1 and Appendix 2 to the circulated report, be approved;

2.              That the Director of Social Services, Health and Housing be authorised to publish a link to the Area Plan and Action Plan on the Council’s website;

3.              That authorisation be given to the City and County of Swansea Council to submit the Area Plan and Action Plan to Welsh Ministers on behalf of the three local authorities and the health board in the Western Bay region.

That grant assistance for Derby Toc H Children’s Camp Derby, for holidays in the Derby countryside for deprived children across the UK, not be approved.

That Members agree to remove the face to face service for Council Tax enquiries in Port Talbot Civic Centre and to replace the service with a telephony and digital solution.

That the application for grant assistance to provide support for Tenovus Cancer Care, to provide support to cancer patients in the community, not be approved.

That the overview Quarterly Performance Management data be submitted for consideration by Cabinet, rather than Policy and Resources Cabinet Board.

That approval to advertise the proposed Traffic Regulation Order for an Individual Disabled Parking Place at 3 Connaught Street, Port Talbot be granted, and if no objections are received that the proposal be implemented.

That the minor amendments to the Individual Disabled Parking Places policy, to include disabled passengers who cannot drive, and the provision of an appeals process should the applicant not be successful (excluding where a decision to decline is made on the grounds of highway safety), be approved.

1.                      That the tariff structure and season permits for the Gnoll Country Park car park be advertised and subject to no objections being received be implemented from 1 April 2018, or as soon as is possible;

2.                      That the Afan Forest Country car park be included in the authority’s off-street parking order;

3.                      That the tariff structure and season permits for the Afan Forest Country car park be advertised and subject to no objections being received be implemented from 1 April 2018, or as soon as is possible.

4.                      The proposed tariff structures at Appendix B ‘schedule’ (as detailed in the circulated report) be agreed and advertised and subject to no objections being received, be implemented from 1 April 2018, or as soon as is possible.

That the following firms be included in the approved list of contractors in the categories below:-

That the proposed Vehicle/Plant Procurement Programme for 2018/19 for vehicle renewals, as detailed at Appendix A to the circulated report, be approved. 

That the objections be over ruled, the scheme be implemented as advertised (prohibition of Waiting at Anytime Order: Prohibition of Waiting, Loading and Unloading at Any Time Order: Speed Cushions at Water Street and Corporation Road, Aberavon, Port Talbot) and the objectors are informed accordingly.

That the objections be over ruled, the scheme be implemented as advertised (prohibition of Waiting at Any Time Traffic Regulation Order at Burrows Road opposite Bosworth Road, Skewen) and the objectors are informed accordingly.

1.              That at Shelone Road/Elmwood Road (Appendix A1 to the circulated report) the objection be over ruled, the objector informed accordingly and the scheme implemented as advertised;

2.              The proposed Traffic Regulation Order at the access Lane adjacent to No.’s 72 to 74 Shelone Road (Appendix A2 to the circulated report) be withdrawn, and the objector informed accordingly.

That the section of unadopted road footway and verge running off Brunel Way, past the new Waterside Medical Practice, leading to the barrier of Neath Port Talbot County Borough Council Service Response Centre, becomes highway maintainable at public expense.

That the report be noted.

1.              That the exclusions from the requirements of competition, as set out in the Council’s Corporate Contract Procedure rules, be utilised;

2.              That Clause 3.1(ii) be utilised for the execution of the work of a specialist nature which will be carried by (Quantum Geotechnical) one contractor/consultant;

3.              That permission be granted to enter into contract with the value to be reported and included in the Council’s Capital Programme.

1.           That the proposed increases in Streetcare Fees and Charges as set out in the appendices to the circulated report, be approved and implemented with effect from 1 April 2018.

2.           That all fees directly relating to the burial of person under the age of 18 years old, be abolished, as detailed in the circulated report.

1.              That further to Contracts Procurement Rules 2.1 (5) and 3 (x), a negotiated extension to the existing contract with FCC Waste Services (UK) Ltd. for one year, from 1 April 2018, be approved;

2.              That notice be given to FCC Waste Services (UK) Ltd that the Council intends to cease operation of Pwllfawatkin Waste Management Facility, Rhyd-y-fro, Pontardawe from the end of the contract extension;

3.              That Officers draw up formal arrangements with Powys County Council regarding sharing their facility in Lower Cwmtwrch from 1 April 2019 and a further report be brought back to this Cabinet Board concerning the details.

1.              That the Local Authority adopt the use of Fixed Penalty Notices for small scale fly tipping of Household Waste in accordance with the Unauthorised Deposit of Waste (Fixed Penalties) (Wales) Regulations 2017;

2.              That the Local Authority set the level of Fixed Penalty Notice (FPN) at £400 with an early payment incentive reducing the fine to £280 if paid within ten days of the FPN being issued;

3.              That delegated authority be given to the Director of Environment and the Head of Streetcare to issue Fixed Penalty Notices under the new legislation, and to appoint specific named competent Waste Enforcement Officers to issue such Fixed Penalty Notices on their behalf.

That the Works Programme expenditure for 2018/19 as detailed in Appendix A to the circulated report, be approved.

1.              That the draft Cemetery Rules and Regulation Policy dated September 2017 be adopted by Council;

2.              That a copy of the adopted policy be provided to all local Funeral Directors and Memorial Masons;

3.              That a link to the policy be placed within the relevant section on the authority’s website.

To keep the Approved List up to date and as far as possible ensure a competitive procurement process, as well as for the purpose of supplying a List of Contractors for invitation to tender within the relevant category.

The decision will be implemented after the three day call in period.

The Approved List of Contractors is promoted on NPT web pages through local events.

That the Capital Programme for 2018/19 to 2020/21 as detailed in Appendix 1 to the circulated report, be commended to Council for approval and that the Programme be kept under review and updated over the coming year.

That the Treasury Management Strategy, Annual Investment, Minimum Revenue Provision and Prudential Indicators as set out in the circulated report, be commended to Council for approval.

That having due regard to the Equality Impact Assessment, set out in the circulated report and Appendix 7 attached thereto:

a)    The following matters be delegated to the appropriate Corporate Director following consultation with the Leader of Council, relevant Cabinet Member and Chair of the relevant Overview and Scrutiny Committee:-

·        Fees and charges applicable for the financial year 2018/19;

·        Fees and charges applicable in any subsequent financial year and which, in the opinion of the relevant Corporate Director, need to be set in advance of the financial year for operational reasons.

b)       The report be commended to Council as follows:

i)      Latest budget position 2017/18 –the revised budget position and arrangements for 2017/18, be approved

ii)     The Council’s Revenue Budget 2018/19

-     the Equality Impact Assessment and Crime and Disorder impacts be taken into account in setting the budget for 2018/19

-     the Net Revenue Budget requirement for 2018/19 and the service plans for the delivery of the budgets, be approved

-     the budget/forward financial plan savings outlined in Appendix 4, to the circulated report, be approved

-     that Corporate Directors be instructed to progress the savings and improvement programme for the Authority

iii)    Fees and charges for non-executive functions That the determination of the following matters be delegated to the appropriate Corporate Director following consultation with the Leader of Council, Deputy Leader and Chair of the relevant Non Executive Committee

-     Fees & charges applicable in 2018/19

-     Fees and charges applicable in any subsequent financial year and which, in the opinion of the Corporate Director, need to be set in advance of that financial year for operational reasons

iv)   Council Tax 2018/19 – That the 2018/19 Band D equivalent for Neath Port Talbot County Borough Council will be £1,496.71.

v)    In relation to the delegation of fees and charges Ward Members be consulted should the proposal be specifically in relation to their Ward.
