RESOLVED

1. That following the site visit prior to today’s meeting on 27 June 2017, and in accordance with Officers’ recommendations, Application No. P2017/0036 be approved subject to conditions and subject to the applicant entering into a Section 106 Agreement with the following heads of terms:
i. A £30,000 contribution to highway repairs; and ii. Payment of a £6,000 ‘Bond’ (to be topped up per annum) to be used for any ongoing repairs to the highway attributable to vehicles travelling to/from the quarry for a period of 30 months.

2. That in accordance with Officers’ recommendation, if within 3 months of the date of this resolution, the s106 agreement is not signed, the application shall be refused for the following reason:

(1) In the absence of a legal agreement providing for a financial contribution for the maintenance of the highway and improvements to passing places on the classified road leading northwards from the site access road to the village of Cwmllynfell, the nature and scale of the HGV traffic generated by the development would have an unacceptable impact on highway safety. The proposal therefore conflicts with Policies SP4, M4, SP20 and TR2 of the LPD.
