At the commencement of the hearing, the Chair welcomed all parties to the meeting, made introductions and outlined the procedure to be followed.

 

Mr. Neil Chapple, Legal Regulatory Services Manager, introduced the report and outlined the key points in relation to the application.

 

Various individual for an on behalf of the Applicant, attended the meeting, and presented evidence and answered questions.

 

Mr and Mrs Thomas, for and on behalf of Other Persons, attended the meeting and made representations.

 

Decision

 

With a view to ensuring the promotion of the four licensing objectives, and in accordance with the principles of the Council’s own ‘Statement of Licensing Policy (2021)’, and the provisions of the Statutory Guidance issued under s.182 of the Licensing Act 2003, the Sub-Committee Resolved to Approve the application for the new premises licence, subject to the conditions outlined in the report which had been agreed between the Applicant, South Wales Police and the Legal Regulatory Service. The permissions are:

 

a.     Opening hours

                                               i.          Monday to Sunday, 10:00 hours – 22:30 hours;

 

b.     Supply of alcohol (on and off sales)

                                               i.          Monday to Sunday, 12:00 hours – 22:00 hours;

Seasonal variation alcohol sales only from 1 April to 30 September.

 

  1. The following conditions were volunteered by the Applicant, and the conditions imposed are:

 

The prevention of crime and disorder

a.     A digital closed-circuit television (“CCTV”) system shall be installed and maintained (or existing system maintained) in effective working order at the Premises. The CCTV will be operational at all times when the Premises is open to the public, and capable of providing pictures/ photographs/ images/ video of evidential quality in all lighting conditions, particularly facial identification. CCTV camera angles are not to be obstructed.

 

b.     The CCTV system must provide coverage of the following areas:

                                               i.          The entrance(s) and exit(s) to the Premises;

                                              ii.          Patio area(s) as identified on the Premises Plan.

 

c.     The CCTV system recordings must be correctly time and date stamped, and retained and stored in a suitable and secure manner for a minimum of 31 days, and shall be made available on request to the Police, authorised officer(s) of the Licensing Authority or other Responsible Authorities.

 

d.     At all times the Premises is open to the public a minimum of one member of staff on duty, who is conversant with the operation of the CCTV system, shall be on the Premises and will be able to operate the CCTV system.

 

e.     The member of staff who is able to operate the CCTV system must be able to show and provide the Police, authorised officer(s) of the Licensing Authority or other Responsible Authorities viewable copies of recent data or CCTV recordings (including footage, images and/or data) in a recordable format (e.g. USB, on-line evidence facility or disk) as soon as reasonably practicable in accordance with the Data Protection Act 2018 and/or UK-GDPR (or other replacement legislation).
