Following the proposal of the Environment, Regeneration and Streetscene Services Scrutiny Committee, held prior to this meeting, Members were supportive of the amendment to the recommendations contained within the circulated report. The recommendations were therefore approved as follows:

 

That having had due regard to the First Stage Integrated Impact Assessment:

·       That the feedback from the consultation be noted

·       That the 25% dimming of LED lanterns be approved

·       That a pilot study of part nighttime lighting be approved, to gain a better understanding of the impacts of such saving strategies and thereby enable evidence based decisions to be made in the future, if considered appropriate. Prior to such a pilot taking place, a further report is brought before Members giving details of the geographical location of the proposed pilot study, the duration of the pilot study, and the times when the lights will be turned off/on, all to be agreed by Members prior to any pilot being undertaken. The results of pilot scheme then being referred to Members to inform any future decisions, if considered necessary. Consultation shall be undertaken as part of the pilot study and shall include an assessment of the impacts upon women and young girls in terms of violence, domestic abuse and sexual violence. The results of that consultation shall be reported to members following the completion of the pilot and consultation.

 

Reason for Decision:

 

To enable some savings to be made to offset the large increases in energy costs, and to provide Members with more information on the impact of part night lighting.

To resolve to exclude the public for the following items pursuant to Regulation 4 (3) and (5) of Statutory Instrument 2001 No. 2290 and the relevant exempt paragraphs of Part 4 of Schedule 12A to the Local Government Act 1972.

That the public be excluded from the meeting during consideration of the following item of business on the grounds that it involved the likely disclosure of exempt information as set out in Paragraph 14 of Schedule 12A of the Local Government Act 1972 as amended by the Local Government (Access to Information) (Variation) (Wales) Order 2007 subject to the Public Interest Test (where appropriate) being applied.

Automatic Number Plate Recognition (ANPR) Camera Request (Exempt under Paragraph 18)

Assessment:

·       That the mounting of ANPR cameras on street lights be approved in principle, subject to agreeing an acceptable Memorandum of Understanding with the Office of the Police & Crime Commissioner for South Wales

·       That delegated authority be granted to the Director of Environment & Regeneration in consultation with the Head of Legal Services, to finalise, agree and enter into an associated Memorandum of Understanding or other written agreement with the Office of the Police & Crime Commissioner for South Wales; and to agree ANPR locations where mounted on highway infrastructure.

 

Reason for Decision:

 

To determine a response to a request from South Wales Police.

Proposed lifting of Restrictive Covenants and sale of a small area of land at The Former Four Winds Hotel, Princess Margaret Way, Port Talbot (Exempt under Paragraph 14)

That having had due regard to the first stage Integrated Impact Assessment, the release of the two covenants and the disposal of land on the terms and conditions set out in the circulated report, be agreed.

 

Reason for Decision:

 

The disposal of the land and release of the covenants will provide the Council with a capital receipt

Proposed Release of a Restrictive Covenant on Land Adjacent to 5 Park Row, Cwmavon, Port Talbot (Exempt under Paragraph 14)

20.

Unity Mine – Request to authorise the release of a bond (Exempt under Paragraph 14)

Decision:

 

That having had due regard to the Integrated Impact Screening

Assessment, that delegated authority be granted to the Director of Environment and Regeneration to:

·       Formally draw down the bond in place with Barclays Bank in respect of Unity Mine made available to contribute towards the cost of completing the restoration of the site in accordance with the approved details submitted under the planning conditions

·       To suspend Rule 11 of the Contract Procedure Rules and enter into any financial agreements with Blue Rock necessary to facilitate onward payment of sums incurred because of the restoration of the site in accordance with the approved detailed submitted under the planning conditions

 

Reason for Decision:

 

To contribute towards the cost of completing the restoration of the site in accordance with the approved details submitted under the planning conditions.
